Legal Question in Criminal Law in New York

County Hold

My son is presently in shock

incarceration but has a hold for bad

ck in a local town court. Can he

request time served for the 10

months he was in Co before going to

Shock? Can he req. PD and sign

affidavit so he does not have to

appear. Will get moved back to

beginning of program if he has to

appear in Ct. Good kid, just made an

irrational decision and has/is paying

his debt back. Please help.

It's going to be important to have a good private attorney to assist you with this situation. There may be a possibility to waive his appearances for some time on the new case, and ensure that he does not lose his place in the program.
