Legal Question in Criminal Law in New York

If I have a court appointed attorney and feel she's not representing me fully, can I fire her and request a new court date so that I can hire my own attorney?

You don't fire your legal aid defense counsel, what you need to do is to hire your own criminal defense lawyer and have him/her take care of being substituted. And you should do so as soon as possible.

Unless the Judge feels you are asking for an adjournment is a delaying tactic, you will always be granted an adjournment to hire a private attorney. Do not fire your current attorney until you have a new one.

You do not need to fire your former attorney only hire a new one, they will submit a notice of appearance on the case and contact your prior attorney In Order to get the files from them.

Generally, it's no issue to be granted an adjournment to hire counsel but this all depends on where the case is and if it's seen as a tactic by the defendant to buy time...
