If someone is arrested for conspiracy at the time of arrest and then during the course ultimately gets charged with a sale of a controlled substance and on several occasions the prosecuters admit that there were NO sales made by this person in his paperwork and in a co-defendants tial how can he be sentenced for this crime and is there a way to appeal this?

Your description of events is probably not complete or is not completely correct. If however this happened to someone you know, all he needs to do to appeal this is to file a notice of appeal with the sentencing court's clerk's office and then apply to the appellate court for in forma pauperis relief(assuming he cannot afford an attorney.) If he can afford an attorney, he should hire one to bring his appeal right away.
