If someone is arrested for conspiracy at the time of arrest and then during the course ultimately gets charged with a sale of a controlled substance and on several occasions the prosecuters admit that there were NO sales made by this person how can he be sentenced for this crime?

Conspiracy is a separate offense from the rest of the charges one might be charged with. You do not actually have to go ahead with a planned offense to be convicted of conspiracy to commit that offense. As long as you made affirmative act towards the forwarding that conspiracy, such as developing a plan of how to sell controlled substance, you are on the hook.
