Legal Question in Criminal Law in New York

i was recently arrested after an altercation with my boyfriend, after punching him in front of the state trooper, she came at me forcing me down to the ground and arresting me, during the scuffle the cigarette i was holding went down the officers shirt and burned her. She is alledging that i intentionally threw the cigarette at her. So i am now being charged with 2nd degree assault with intent. Also being charged with criminal mischief, assault, and resisting arrest. I have never been arrested before, this was all just one big mistake.....will i go to prison???

You need to hire an attorney right away so this matter does not get out of hand

While a prison sentence is possible since it is your first arrest your attorney should be able to negotiate a non-jail disposition. However, there are no guarantees. Furthermore, the prosecutor may decide to reduce the assault charge to a misdemeanor which is fairly common. You should retain a qualified criminal defense attorney to handle this case for you.
