Legal Question in Criminal Law in New York
Criminal Mischeif..? Different Counties..?
I have a friend that has a question about something that he was involved in, and he is trying to figure out if he should be worried about the situation, what charges he might be facing, and if it matters if he lives in the next county over.
The friend supposedly pulled a air conditioner out of a houses window, and the poeple that where with him threw something at a window an possibly broke 2 ordinary sized windows.
My first question is what kind of criminal charge is this ?
My next question is, if the city police where called for this incident and if my friend an the poeple that where with him live in the next county over will the city police still persue it ? Can they and if they can is there a good chance they could transfer this investigation to the state police ?

Remembering I practice daily in Florida breaking windowa in probably criminal mischief. Removing air conditioners is probably grand theft. I also see a potential attempted burglary if they claim shattering the window or removing the window is an attempt to enter the house to commit a crime. Where your friend lives is irrelevant, where the crime happened is the controlling issue. For example if I robbed a bank in New York City but lived in Westchester County, I would expect the NYPD to come knocking.
