Criminal possesion of Marijuana 5th Degree

I was stopped on the corner of my house by an undercover narcotics agent if I had any drugs etc on me. I told him I had marijuana - I only had a very small bag he then searched me and took everything out of my pockets. I was just walking to my friends. I was taken to the Preceint and then I let go and given a Desk Appearance tkt but they were doing a sweep they had 6 other people in the van and told us they had to find 3 more. Iwas in the van for almost 2 1/2 hrs. I have a court date of 01/10 will I be convicted of a misdeamnor

You will probably not be convicted of a misdemeanor. You are more than likely (assuming this is your first arrest for this)eligible for an Adjournment in Contemplation of Dismissal. (aka an ACD or on Long Island an ACOD).

YOu should however see a lawyer and you should also be aware that you do not have to answer an officer that asks that or any question of you. You have a right to remain silent. Use it.
