Legal Question in Criminal Law in New York

criminal procedure

my boyfriend was at his friend's house and there, they had a raid and he was taken to jail. He was charged with possession of drugs and weapon even though he did not have any of them in possession nor neither did he knew that those contrabands were in the house. It has been almost 80days since he has been in jail. His attorney (public defender) tells him that his case is beeing reviewed by the grand jury. The question is that he still doesn't know whether he is indicited or not. Does grand jury take such a long time to come to a decision? What is the process of grand jury in ny and how long does it take to have a decision? I really appreciate your knowledge... I really want him to be back for this holiday sesaon....

Re: criminal procedure

The DA has been very slow. There are rules about how long they may hold him before submitting the evidence against him to a grand jury.
