What r other options if a person can't afford an atty since legal aid does not accept criminal cases, nor do pro bono attys.- and assigned atty (pub defender) is overloaded therefore not able to properly give the case it's needed attention

The Legal Aid Society in NYC does mostly criminal work. If the public defender is overloaded he must notify the court. If you otherwise qualify for legal assistance, then the court will have to appoint a lawyer for you, unless you are not charged with a crime.
You can also contact a law school to see if they have a clinic program where you can be assisted for free or for a reduced fee.
