Can I be criminally charged for selling items my corporation was throwing out. These items were given to me by a warehouse manager and were not in the inventory, hence the reason for discarding.

The answer is: Probably. The reason why is that there is likely a discrepancy between what you were told by the warehouse manager and what the actual situation was. There's also a fundamental legal difference between 'was throwing out' and 'actually threw out'. It's akin the difference between going through someone's garbage in their bin and dumpster diving.
