Legal Question in Criminal Law in New York

I have a DAT for Petit Larceny (155.25) for $140 of merchandise at Uniqlo in Manhattan (4 items). This is my first offense of any kind (I just turned 22). I was held by security in store, where they had me sign a trespassing agreement for the future and told me I would receive a civil demand letter.

They called the police, who gave me a DAT. I did not get a copy of the police report or anything else. Should I be aiming for an ACD or Disorderly Conduct? Should I be worried about any jail time? Do I need to hire a lawyer?

You need a lawyer because the DA will charge you with two Class A misdemeanors: petit larceny and criminal possession of stolen property in the 5th degree. An ACD will be the goal. Do not pay the civil demand. Feel free to contact me if you are looking to hire a criminal defense lawyer. I handle these cases all the time. You are not going to get jail time.

From the information provided it is highly unlikely you will receive jail for a first offense petit larceny etc. This case will be "plea bargained". If you can afford one I would suggest that you retain a competent criminal defense attorney. The outcome of this case will affect your future. You may contact my office @ either 718-834-0087 or 917-353-1048 for a free phone consultation.
