Should I hire an attorney, he had a previous 140.10 arrest (2 weeks prior) and was on 6 months conditional discharge (probation)?

Yes, based upon the limited amount of information that you state here the person needs a lawyer immediately. The probation department will violate him and the District Attorney will open the prior case under the conditional discharge. He needs a Lawyer now.
