Legal Question in Criminal Law in New York
What is the definition of being arrested? Is getting handed a pink summons (NYC) for PRR 1-03(a) count as an arrest? (Assuming the person was not detained and let go)

There is no statutory definition of an arrest in NY. Per the case law, receiving a pink summons is likely not an arrest but you have still been charged with a misdemeanor, which is a crime.
