Legal Question in Criminal Law in New York
Disorderly Conduct and Petit Larceny
I was arrested in 2001 at the age of 18 for petit larceny. I was convicted of disorderly conduct which i know is a misdemeanor.I am now 25 and am applying for teacher certification in NYS and have to get my fingerprints taken for a criminal background check. I am not sure if I have a criminal record will all this appear? I am very concerned, please advise.

Re: Disorderly Conduct and Petit Larceny
Disorderly Conduct is a violation (Penal Law sec. 240.20); it is not a crime. I can't say for certain whether it will show up on your fingerprint check. Its not suppossed to but nevertheless used to. I read that the Dept. of Criminal Justice Services was going to start making non-crimes show up but I believe that certain entitles (like law enforcement) always see your full history. The above is for informational purposes only and not meant as legal advise as there is no attorney-client priviledge.
