DNA Testing
the district attoreny of kings county, new york state want a defendant in a robbery case to submit to dna testing. Can the defendant deny dna testing and if so on what grounds. allegedly the robbers were mask during the robbery. what rights can the defendant exert?

This is a rather complicated issue. Basically the District Attorney's office would make a motion to the Court compelling the defendant to give a DNA sample (e.g., blood, hair, saliva etc). The defendant should have a retained attorney in a situation such as this to represent them during the process. Please feel free to contact my office if we can provide any assistance in this matter.

DNA testing can be compelled by order of the court. Have you been arrested?Indicted? Were you represented and if so by whom? Can you afford private retained counsel?These questions must be answered before more specific answers can be given.
