Legal Question in Criminal Law in New York

Domestic Violence 3rd Degree Assault, Should I bother?

For the past year I've been constantly harassed by my now ex boyfriend. We've been in two physical altercations, both leaving me beaten and bruised. The first time I said nothing and fled back to my home state with my mom. I was advised by my landlord and his mother to no call the cops, for their sake.

I am constantly being intimidated and he threatens me if I go to the cops, he'll try to ruin my record as well. The one problem is that in effort to defend myself in the first fight I bit him so he could let go of me, and he says that ''I bit him so hard he needed to go to the hospital... for a tetanus shot...''

He also jumps back intimidating me saying that I'm physically abusive as well, which I am absolutely not. The most I've done is shove him away because he harasses me in public and I need him to get away from me. I'm not sure how anyone else would view that.

I'm tired of getting hit, I'm tired of him coming back and lying to me and sneaking his way in my life to take advantage of me, I'm tired of being intimidated and bullied around. How far can I go with this? Can I get him in jail, and for how long? I have pictures of the harm he did to me from Feb and still have the bruises from a couple of days ago.

You need to go Run infact to a battered woman's shelter. YOu further need the help of a lawyer who will get you an order of protection and will help you figure out ways to stop this abuse.

YOu can get him arrested and with good representation you can get him to leave you alone too.

If you would like to speak further, follow the links below. Whatever you do however, get out of harms way quickly. His ability to control you and scare you is his greatest ally. His threats are empty. No one needs to live like that.

Good Luck.
