Legal Question in Criminal Law in New York

drug possession of a minor

A 16 year old was arrested in school for an ounce of weed. He has a bench warrant and his court date is a day before his 17th birthday. Two weeks before his 17th birthday and his court date he is arrested again for possession of weed and driving without a license. What is the maximum and minimum sentences he can recieve and what type of court is he going to be trialed in? Basically what is going to happen to him?

Re: drug possession of a minor

This case will be tried in the regular criminal court (adult court). There shoud have never been any failure to appear on the original weed charge, there is usually an ACD offered in most counties on such a charge, which is basically a dismissal... The second charge is more serious, as well as the bench warrant, the driving without a license now adds to the seriousness of the new charge.

However, with proper counsel he should be able to receive a non jail disposition and a sealed record, My office is prepared to help you with these cases if you are prepared to retain us.
