Legal Question in Criminal Law in New York
drug possession
if a young man of the age of twenty is stopped by police and told to get out and empty his pockets,he has nothing but his friend has drugs what will happened to the man without drugs. will he have to do any time ,he has no criminal record of any kind.the other young man had marijauna on him

It sounds like this involved a vehicle stop. The law provides for something called "constructive possession," which means that even though the drugs were found on one passenger, all the passengers will be treated as though they were in possession of the drugs. Obviously, if you are not physically in possession of the drugs you are in a better position to negotiate a better deal.
