Legal Question in Criminal Law in New York

I was convicted of my first dwi and recived a year.It was thrown out because i wasnt offered a psi .The judge then set no bail no release until one was completed and was going to resentence me to a year.Where my rights violated because i wasnt offered a psi and spent 157 days in jail?

On the first DWI it is rare that you would be given the maximum penalty. There must have been extenuating circumstances.
Not setting bail is also unheard of. You could have gone to a superior court to have the no bail reviewed.
Your rights were violated, but the judge is going to rectify it by giving you significant jail time.
