Legal Question in Criminal Law in New York

employee background checks/partial sealing or sealing

I am so confused. I am seeking employment and scared about background checks.I have a disorderly conduct and dwai both were said by judge to be violations with no criminal record.Well three months after the cases were finished they apeared on a background check. I thought they were not put in the system as a crime. Should they be showing up.Is there any way I can stop this madness. It has been four years. Can I seal these convictions from employers. Also what is a partial sealing of records160.55. Can someone help me? I live in Nassau County, they are very strict.

Re: employee background checks/partial sealing or sealing

We have handled a number of these sealings. At the time you took the plea's it was everyone's understanding that the file, including the court file would be sealed.

We can make a motion to try to seal the record. Our offices are in Nassau County.

Call us or follow the links below if you are interested.

Good Luck.

Re: employee background checks/partial sealing or sealing

Based upon your description of the offenses these are not crimes (hence you do not have criminal convictions) and therefore may be sealed. The problem when taking a plea to such an offense is they often do not get deleted from the system and they pop up when background checks are run. Please feel free to contact my office if we can be of assistance in this matter.
