Legal Question in Criminal Law in New York

One evidence?

In my boyfriend's case, he's charged with 2 buglaries which he did not commit but anyways, out of both cases, only one girl did a photo lineup. That is the ONLY evidence in this whole case. Is that argumentive or is one photo lineup pick out enough to even convict someone?

Re: One evidence?

This ID evidence may be legally sufficient; but if it's the ONLY evidence, your boyfriend should walk free without a problem.

Re: One evidence?

generally a single piece of evidence may be enough for a conviction, it depends on the weight of that evidence and the believability of the testimony involved. Furthermore, no evidence is usually 100% proof positive of any action, instead it is usually used in balancing guilt or innocence.
