Legal Question in Criminal Law in New York

Exspungment

My son was picked up with a friend by the police. The friend was selling marijuana to another person. Originally the police was letting my son go and arresting the friend and the person who bought but the person who bought made a deal and told the police that my son was the one that gave it to him. My son and the friend were arrested and the person that bought was let go an hour later. My son was given a court date and told by the DA that he would probably just get 2 days community service. My problem with this is my son had nothing on him and did not sell. He has no prior record, working full time, and getting ready to attend college. I am not ok with there being any type of record being that this person lied on him. There is no evidence yet he was held for criminal possession and sale of marijuana. The person driving even told them that he was the one that sold and that the person that bought was just afraid of him. Please advise how I can go about helping my son to get this record expspunged.
