fake id while on probation

my 19 year old son was ticketed for having an open can of beer this summer and is presently on a 6 months probation. this weekend he was stopped by a policeman (for being near a car of kids smoking pot, which he wasn't involved in) at 5am in a college parking lot and asked to show id, he took out his wallet and the officer asked him to give it to him, upon searching his wallet he found fake id. he took the id and gave my son a ticket instructing him to appear in court on oct.21. what will happen there? does he need a lawyer?

Speaking with a lawyer would be a good idea. You son may be facing criminal charges that could have significant penalties, although I would need more information to determine his actual exposure.

With the fact that he is on probation I would ABSOLUTELY suggest hiring an attorney to appear with him on his court date.

It may very well be possible for them to treat the summons as a violation of probation, it may be addressed there and then or it may be referred out to the sentencing judge to hear the matter of the violation of probation, overall regardless of the outcome... he should have good representation as a result of the fact he oculd potentially be looking at jail time.
