Legal Question in Criminal Law in New York
false arrest
my boyfriend and his daughters mother are going to court for custody/visitation. In order for the court to susspend his visist she said she doesn't trust me around her daughter who is 3yrs old. She then went to the precent and said that i choked her daughter and i was later arrested for endangering the welfare of a minor. I was later released from central booking with out seeing a judge they said that the disrict attorney had no proof to prosecute me on those charges and the charges where thrown out. My boyfriend and i live together and we have been living together for the last 7years. We have a 3 yr old as well. my daughter is 3mos older than his other daughter(he slept with & inpregnanted her while we were together)In the beging of his custody battle she accused him of hurting the child. He had to go through supervised visitations and now he gets to see his daughter every weekend since the judge granted him weekend visitation while they await trail on the custody battle. She filed false alligation including calling ACS on me and my boyfriend. She has gotten a order of protection by manipulating the system(on him)where he falsely been aressted. She got a temp order of protection against me. I'm scared don't know what to do

Re: false arrest
You may want to invest in an attorney who will agressively pursue an action against her for false arrest. You should have your lawyer demand a hearing on the TOP and be sure he fights the underlying case. He should use an expert on child abuse to disprove her false claims. Then you really have to consider her daughter, your little girl's half sister. You may be wise to try to help your husband to get custody of the child before this crazy woman completely poison's the child against the rest of her family.
