Legal Question in Criminal Law in New York

federal parole fugitive rights

i would like know if a federal parole has any rights. my boyfriend was picked up in north carolina by the u.s. marshals and arrested by a warrant from new york(so called) but the only warrant was that of his parole violation of 13 years. new york came out and showed him pictures of the crimes and offered him a plea deal of 3-5.He has not had a hearing or a public defender hes been in custody over a month now. ny keeps taking pictures of him.and just heard they are transfering him to a fcc to see the parole commision. What happens to the state charges if any? I have tried legal aid, aclu, and the bar association. How can i get legal representation for him?How long can they detainee him with out a hearing? Can he have an extradiction hearing? If there are charges in ny why cant he answer to them? There is something fishy about all of this.

I am responding through lawguru, but have also responded to your personal email regarding this matter.

Overall, Federal and State matters are kept seperately in most instances. I'm assunming that the case in New York was a Federal matter?

I would need further detail as to what the original charge was in the case? when did parole begin? how much time was served and whether it was a Federal facility.

Federal matters tend to be much slower than State matters, and being detained by the Federal government tends to make a case much more difficult on the defense.

I would be more than happy to further discuss your case. Feel free to contact my office for a free phone consultation to further discuss this matter, so that i may be able to give you a more fully developed answer.
