Legal Question in Criminal Law in New York

felony charges and plea bargains

I am a 45 yr female with a spotless criminal record. I have never had any problems with obeying the law. During a domestic occurence I drove the car I was in into that of my then boyfriend. I was on the verge of sucide. The car in turn hit two other cars in the parking lot. I also had an unloaded pistol in the trunk of the car with a clip. That was not to hurt anyone, it was for me. I admitted to the act on the spot. I was jailed for 30 days and they now had me sign a plea bargain for two felonies and a misdemoner. No one was hurt. I was later diagnosed with biploar/depression by three different doctors. Is there anything else that could be done to reduce the felony charges? I am going to be serving ten weekends in jail and five years probabtion. At the time of the incident we were living in the same household. I was told that the order of protection is permanent. Do I have any legal rights to obtain my personal belongings?

Re: felony charges and plea bargains

I'm sure that with consent of the DA and the court, you can arrange to retrieve your belongings with police presence. As to the plea bargain only your attorney can evaluate it based upon knowlege of the circumstances and the relative strengths of the peoples case. From your description your admission plus the physical evidence indicates a strong case.
