Legal Question in Criminal Law in New York

Old felony conviction

Hi. 20 years ago this year I was convicted of a class d felony for attempted robbery. At that time I was a terribly addicted crack/cocaine addict. As a condition of my conviction which I volunteered myself I went to a drug rehab program. I successfully graduated this program and applied for and received a Certificate of Relief from Civil Disabilities. At that time I was in really bad shape and the only reason I committed that crime was to get money for more drugs. I miserably failed at that and was subdued by the people I tried to rob, arrested and convicted.

I was wondering if I could get this felony conviction cleared off my record. I have spent the last 20 years making a better life for myself. I am married own a house and am doing very well and have never had any trouble since then.

Please advise because this really still bothers me.

Thank you.

Re: Old felony conviction

It is possible to make a motion to set aside the judgment of conviction under CPL 440. These motions are difficult to win and I would need to know a lot more about your case before I could advise you.

If you would like to discuss the possibility of clearing the conviction, please give me a call.
