This all depends on the situation, have you been charged with the crime yet? if so then the DA's office has six months to bring a case against you before they must dismiss under 30.30, the constitutional limit (statue of limitations) on such cases... If you have not been caught, then the statute of limitations is probably in the area of 2 - 5 years, however... so long as you posess the instrument then you are still in commission of the crime under the law and the statute of limitations does not begin to run, obviously.
