Legal Question in Criminal Law in New York
fight with father
i was involved win a fight with my father. i was abused by my father my entire life, mentally and physically. a few nights ago my mother came home crying from my fathers home and as soon as i saw my mother crying, i had enough. my father arrived at my mothers a short while later, and 16 years of fear and anger came out at once. i punched my father a few times and he began to choke me and slam me against my house. my mother and sister are witness to this. i broke away from him and ran into my home to get a knife to try and get my dad to leave, i did not have the intention to stab him, just to try and get him to leave. my father left and a few minutes later a police officer came to my house and arrested me. i was put into my local precincts jail for the night and arraigned the next day on 3rd degree assualt and menacing. now my father did not state on the police statement that he choked me. he only said i came out, punched him and ran inside the house and got a knife. i just want to know what i can do legally.

You have a very good defense here - Self Defense with witnesses. You need to get a lawyer who will contact the DA's Office to discuss dismissal or some reduced charge.
