Legal Question in Criminal Law in New York

fight at a night club

hi. my boyfriend got arrested for

fighting in ny night club. two guys

attacked his buddy w broken beer

bottles, he stepped in and he broke the

guys arm and hurt another one.

because he didnt get hurt himself it

didnt count as self defence. its his first

offence. probation officer said that if he

pleads guilty she will get him out the

same day and he get 5 yrs probation. he

did that..and now he has court

tomorrow and he spoke to prob officer

today and she said he might get time

now...what the chances? anything he

can do? one more thing - he is certified

martial arts trainer, i know that makes it

worse...please help...thank you for your

time.

Theres a lot that can be done in a case like this.

I'm also a martial artist so i can sympathize.

You're being offered probation and did a PSI for probaton, this doesn't mean that you have to accept this offer nor that it is the only offer possible.

Just because there was no njury doesnt mean he cant claim self defense, also there is a claim of defense of others that exists in law also.
