Legal Question in Criminal Law in New York

I filed a restraining order in family court against my ex for a recorded phone call in which he threatened to hurt me. He has told me stories of his violent past and I was sincerely afraid. He retaliated by filing a false order against me citing harassment, sexual abuse, assault, etc. Can I still give the police the recorded phone call even if it was a few months ago and can he be criminally prosecuted? Thanks!

What you don't say in your question is if there was an order of protection for you from your ex granted by the court. If they granted the order it would seem unlikely that you would need the recorded phone call. If he called you before the order of protection was in place then he wasn't in violation of the order.
