Legal Question in Criminal Law in New York

filing a motion to unseal

In 1999 someone was arrested with my same name and a different DOB for some reason that persons record has been linked to my NYSID#. The record is sealed the persons case was dismissed also no fingerprints or photo in file. I've been told by the Queens County Clerks office if I need a letter from a judge or any ''official'' stating that this is not me I would have to ''file a motion to unseal''. My question to you is do I need a lawyer to do this for me, can I do this myself, If I do need a lawyer is it a lengthy process and/or very expensive? Thanks in advance for your assistance.

Re: filing a motion to unseal

Overall, if the charge was dismissed I woud like to know why it is that it is so important to have it cleared from the record... this is something that may cost you quite some money and may be of absolutely no benefit what s ever to you, realistically.

I am able to do what it is you are requestiong, and it will not necessarily take very long, but i am left wondering why it is you want to pay to have this done...
