Someone forged my name on a contract - criminal case or civil case?

I signed a contract with a health club. They later claimed I had signed a different contract, with different terms, and forged my signature on the contract. The total value of the forged contract was about $1300. I refused to make payments on the contract after informing them that it was invalid, and they reported a default to my credit bureau. I filed a complaint with the New York City police (I live in NYC), which was recorded but they did not investigate further (ie asking for evidence).

Is the forgery a criminal case that I must pursue through the police? If I decide to sue in small claims court what would I sue for?

Report the forgery to the police. Then, if it shows up on your credit report, use the police report to get it taken off.

What can you sue for? What money have you paid to the club and did you use the facilities?
