Legal Question in Criminal Law in New York

Forged signature on options document

My husband had my signature on a joint stock option investment forged to then take advantage of a converted offer but put in his name only. We are now separated and going through the division of assets process. What recourse do I have? We live in NY but this instrument was a California company.

Re: Forged signature on options document

It is illegal for your husband to forge your name, have the stock option put into a different account with his name only.

Since you were married to him during this time, you would still be entitled to 1/2 of the value of the stock option even if it was in his name.

Furthermore you could contact the stock option investment itself, and make a complaint that they didn't have your authority to change the nature of the investment, and make claim against the investment company that did so.

It doesn't make any difference where you live or if it was a California Company.

You do have recourse against both your husband and the company.
