what is the legal situation regarding receiving things by fraud in New York and/or the united states

This question has a lot of twists and turns and caveats. The general rule is that the person committing the fraud may not retain his/her gains. In addition, he/she cannot pass good title (the original owner stays the owner). But, in the absence of an original owner, the courts will not move possession from one person to another.
