Legal Question in Criminal Law in New York

want to know about the free lawyer apply processing from the court

I went to the legal-aid office before. It has someone to tell me, I don't need to find a lawyer yet because you should get lawyer from the court and that is free too. Therefore, I just want to know I will be fine if I just apply the free lawyer in my court day. How is the processing for that apply? The lawyer will defender for me in my first court day, will he or she? Or just appear to the court and the lawyer will reschedule the other court day for me, will it? More over, I still have three questions: is it a good experience for the free lawyer? if i am not a citizen or resident in here, will I have a chance to get that? and will the jurdge ask my identity when I appear in the first court day? Thanks your time to help me, I am very appreciate it.

The only qualifications for legal aid are that you earn less that a specific amount of money per year.

If you are not a citizen you still qualify for this service. Overall, legal aid does provide a good service, but will of course never compare to the quality of a private attorney.

When you show up to Court you will be given a legal aid attorney once they call you in front of the judge... make sure you arrive on time and are not late for Court that day.

If you are not a citizen or resident depending on the type of case it may affect your ability to apply for residency or citizenship in the future, but it may not this all depends on the type of case this is.

If one cannot afford a matter on a criminal matter, the court usually appoints a lawyer. This lawyer agrees to represent the defendant in a criminal proceeding. Some are new lawyers looking for experience. Some are old lawyers who feel an obligation to the community.

The experience, and knowledge of a lawyer varies as it does in the whole legal community.

When a criminal defendant is arraigned, they are asked if they can afford a lawyer. If they say know, they are asked about their employment and resources. If the court and the referring agency are satisfied that the defendnt cannot afford a lawyer, they will appoint one. You will then meet with that lawyer, and he will then represent you at any future court appearances. These free lawyers are not part of the court, or of the prosecutor.

Some people refer private lawyers, who will take a personal interest in your case. Free lawyers can be overwhelmed by the number of cases they handle, and by the lack of resources that a paid lawyer has.

The difference between a free lawyer and a privately paid lawyer is dependent upon the lawyer itself.

Whether or not you are a citizen is irrelevant. Every person in a criminal proceeding is entitled to a lawyer, free or not.

You should consider one thing - if you are convicted of a crime, that could be a basis for your being denied citizenship, and being deported.

So get the best lawyer you can. If you are convicted of a crime, you can be deported - this is what is called the double whammy.
