Legal Question in Criminal Law in New York

Friend afraid of jail time if parole is violates, wants to flee country

My friend's a 17 year old going on 18 in September, on probation for drug use, he is in a program but has been ''cutting'' his program for the last 3 weeks now. I know that he is risking violating his probation and going to jail. He feels the need to leave the country although he is not allowed to leave the country or state. What are the consequences if he does attempt to leave the country and are the airports up to date with a person's criminal record, especially that of a minor?

The reason my friend wishes to leave the country is because he has already smoked marijuana in the last week, and going back to the program he is in, they would test him and catch him and he believes that they will send him to prison instead of just adding more probation or other things other than jail time. What are the chances he will be allowed to continue probation and not get any jail time knowing that until now he has been going to his program and seeing his probation officer on time?

Thank you for your time and help in advance.

Re: Friend afraid of jail time if parole is violates, wants to flee country

1. The airports will not be on the lookout for your friend, unless a warrant is issued for his arrest -- which could happen after a while.

2. Your friend may not go to jail or prison, even with a positive test for pot -- because of his age. All of the things you mention are Violations of his parole, however. For more info, E-mail [email protected] or call 718-273-6229.
