Legal Question in Criminal Law in New York

my friend

i have a friend who is having some major issues. her b/f may not be able to make a possible court date concerning their child, but if he cant make it to the court during the week, is he able to still take his child every other sunday or every sunday as their prior court order inflicted?

Hi:

Your question about your friends b/f court date did not have enough info for me to comment. If he has a court date, he should be represented by counsel that request the judge for an adjournment. Generally, if there is a court date there should be a very good reason for non appearance, especially, if it involves custody, criminal, restraining orders, etc.
