Legal Question in Criminal Law in New York
I used a friend of mines debit card without permission. She requested that I pay her back and she also said that she is not pressing charges. If she changes her mind and decides to press charges what could I possibly be facing.

You could face several felony charges, including, but not limited to: identity theft, filing a false instrument, grand larceny, forgery. Depending on the amount of money you stole, you could face as high as a class C felony offense. Most likely, the highest count you will face will be a class D felony offense, punishable by up to 2 1/3 to 7 years in jail if you have no prior felony convictions. If you do have prior felony convictions, and the charge does not get reduced to a misdemeanor, prison time is mandatory; the minimum on a D being 2-4, maximum being 3 1/2 to 7. Hopefully, your friend will stand by her word, but don't count on it.
