Legal Question in Criminal Law in New York

grand larcency and fraud

I am a builder that received money to perform work, I done work at the plantiffs home , there was conflict and was not to return to the project. They had another project that I was to erect , I received a deposit , they wanted there money back I wanted to give them what I thought was apropraite, they wanted most of there money back, now I,m indicted by a grand jury and charged with third degree grand larceny and fraud. What should be my defense and I 'm not happy with my attorney , I feel they are over charging me, and its hard for me to make payments to him if I'm trying to make restortution to the plaintiff. I know it should be a reasonable amount of money to do this because it may intail a trial. I 'am afraid to go to jail and want to know the course of action I should take and what could I be facing. thank you please contact me ASAP I have a conference on June 11, 2003

Re: grand larcency and fraud

It sounds as if you are truly caught between a rock and a hard place on this case. You have described a commercial/contract dispute more than a criminal case. I am interested why the police/district attorney are involved.

In any event, they are involved. Your attorney should be making every effort to get the charges dropped or reduced in exchange for restitution. In the absence of an actual trial, your legal costs should be under control.

You are welcome to a consultation at no charge at my offices at 42 west 44th st., ny,ny. Please call for an appointment frist - 646-591-5786
