Legal Question in Criminal Law in New York

Grand Larceny

I was arrested and charged with grand larceny at my job bank of america. I tried to steal 4020 but got caught with it and the money was given back. I have been having a lot of personal problems, just came out of a surgery and this is the worst thing ever I did in my life. I have to appear in court on July 24th, never been arrested before. Will I go to jail? Please help?

Re: Grand Larceny

I would make no further statements to the police. I am assuming you made statements to the loss prevention officers at Bank of America, so they already have a statement to use against you. You should retain a qualified criminal defense attorney to represent you in this matter. If this is your first offense it should be possible to work out a non jail disposition. However, nothing is a guarantee. I have significant experience both as a prosecutor and defense attorney handling cases of this nature. Please feel free to contact my office if we can provide assistance in this matter.

Re: Grand Larceny

Whether you go to jail or not depends on the plea bargain offered by the DA's office. Your chances of avoiding jail, in my opinion, are good, because you have no priors. I would need more info about you and the incident, though, to be comfortable predicting the outcome.

Re: Grand Larceny

The likelihood is that you are NOT going to jail if this is your first offense but you do have some exposure. Did the DA charge you with a felony or misdemeanor? Have you retained a good criminal defense attorney? I am a former Assistant DA and federal prosecutor as well. Please feel free to contact me.

Re: Grand Larceny

With the representation of experienced counsel as it is your first offense an attorney should be able to work out a plea where the charges would be substantially reduced and you would not have to serve any time in jail. This area of law is our specialty, however, we would need some more information before making a complete and proper determination. You are welcome to contact us for a free consultation.
