Grand larceny

Do a person always gets imprisonment time for 4th degree grand Larceny? if its there first time?

Based upon the information stated ,it seems that there is great descretion in the sentence you may receive. It may be jail,it may be probation. In New York State, Grand Larceny in the 4th Degree is a class E Felony.

Commonly this crime is charged when someone steals a credit card of an item valued at over $1000 but under $3,000. (It is also charged when you steal secret scientific material, like the formula to Pepsi!!!!)

The maximum jail time one can get for a Class E Felony is 4 years. The minimum time is flexible. It can be a year or less. It can even be probation. The sentence depends on several factors like whether it is in fact your first conviction, whether one of those other convictions was for a felony, or whether the prosecutor wants to cut you a break.

Speaking of breaks, if it is your first arrest (you have nothing else showing on your rap sheet) it is worth your while to see if the DA will give you an even bigger break and let you plead to a misdemeanor or better. What have you got to lose, right? Don�t expect this courtesy of you insist on testifying the Grand Jury* but otherwise � hey, consider giving it a shot!
