Legal Question in Criminal Law in New York

Grand Larceny 3rd

My fiance was arrested for Grand Larceny in the 3rd, a D felony. It's his first time being arrested. His employer recovered most of the merchandise ($3,000-$10,000 worth..they were tires).

What's the likelihood that he'll walk away with no jail time? He signed a confession already (he was caught red-handed anyway). He's being completely cooperative. Bail was set at $2500. What kind of time is he looking at (you know...best and worst case scenario)?

If you've had experience with these sorts of charges, what have you seen happen?

Hi my name is Shawn Kassman, I represent a number of individuals that have been charged similar to your fianc�. If this is his first time getting a trouble and he can pay for what was allegedly taken at a minimum they should probably reduce the charge to a misdemeanor, perhaps even a violation which is not a crime. It is very unlikely that he will be looking at any jail time.

If your fiance has never been arrested before then there is a good chance that this case could be reduced to a misdemeanor. However, this will depend on a number of factors including how aggressively the employer wants the charge pursued.
