grand larceny

what is the statue of limitations on a grand larceny charge of the 3rd de gree, if the act acoured in 1993 and is being prosicuted in july of 2005. is there a statue of limitations on this?

Hopefully a New York lawyer can tell you the actual number of years because I don't know. But the statute of limitations is different than speedy trial and people get them confused. If the crime occurred in 93 and the DA has done nothing to pursue the case the staute has probably run. If however an arrest warrant went out, or you were arrested and failed to appear, or you were in another state they have prosecuted within the staute and they have a few months to bring you to trial under the speddy trial. So its possible to pursue an old crime if the State ha been dilligent.

The statute of limitations on this felony is 5 years. There may be additional defenses, however, if the felony complaint was drafted in 2003, but the police department waited two years to arrest you, or if you were arraigned on the GL 3 degree charges in 2003, and the DA's Office waited until 2005 to indict.
