Legal Question in Criminal Law in New York
grand larceny 4th
I was convicted of grand larceny in the 4th in June. I was with 2 people who took items from a store up in pallisades mall in NY. We got pulled over and questioned and the items were in the back of my truck. The cops arrested me and searched my truck without permission. The lawyer I have seems unconfident going to trial saying I have a 20% shot at wining. The offer I got was 5 years probation and 3 months of community service with a Class E felony on my record. This is the first time I've ever been arrested and the judge dismissed a proposal for an illegal search. I was in new city NY and the items taken estimated to be around $1500. If I fight it and loose I was told I can get anywhere from 6 months to 2 years in jail. My lawyer also told me that they are very hard on people who shoplift in their area and punish them to the max. Am I at a loss or is there a possibility of me coming out of this without going to jail and no felony charge? They refuse to lower it to a misdemenor. I have no faith in my lawyer and I think he is pessimistic. Is there anything I can do??

It appears to me your attorney is afraid to try the case. A trial may be your best option here; it's very hard for me to say, of course, without a lot more information about your case.
