Legal Question in Criminal Law in New York

What can happen to me?

A year ago my cousin and I ( she was 13 and me 17 ) Kissed once! We were playing there was not tongue in the kiss. She used to come to my house all weekend's. my aunt saw that we were always together and asked to her ''what was happening '' she said that I was following her to the school! ( that's not true ) I thought she said that because she was scared. The thing is that my aunt went to the school to change her and told everything to the counselor ( her version ) they said that she had to put charged against me and she did. They picked me up and I said what happened they gave a misdemeanor B in the third degree! the dectetive told me that they wouldn't put me in Jail for that. i havve two court coming up! one for the proctection order ( family court ) and the other one of Criminal court ( the school made a charged against me ) What can happened to me? She had turn to 13 years old by that time. now she's 14 and I am 18 So the question is What can happen to me? Jail? I Talked before to an attorney and he said that they wouldn't put me in Jail for that but I'm really scare because she's lying!

Re: What can happen to me?

with ANY criminal case there is always the potential for jail. In such a case if it is a first offense, the possibility for jail is very minimal. However, recent changes in the law have doubled the time for probation on any sexual offenses, this means what while normally probation on a misdemeanor is 3 years and 5 years for a felony - for sexual offenses it is 6 years for misdemeanor and 10 for a felony.

It is VERY important you seek the help of an experienced attorney. Please feel free to contact my office for a free consultation, you may reach us at 212.709.8303 (hablmaos espanol)
