Legal Question in Criminal Law in New York

Harassment and threats

Hi, I would like to know if someone is known to have a violent past and is now making threats and harassing phone calls to me, can I get a restraing order even though he has not hit me yet? This is an ex boyfriend who is 47 years old, he is also slandering my name and threatening friends. What else can I do if the police here are afraid of him? They already let him walk on a hit and run with no insurance.

Re: Harassment and threats

yes, you can get a restraining order... contact the local police and file a report with them - if you push it htey must file charges and arrest him... you can then get a restraining order... howevever, enerally the threats have to meet a certain standard and have to be credible/ reasonably believable... and also the language of the threats are important..., also there must be a pattern of harassment over time...

contact the police, theyre your best bet...
