Is harrasment when someone wont leave you alone?

I have a daughter with my ex who is going to be 2years old. Since her birth we ave had no relationship and every few months after he got married he calls the police on me and trys to get me in trouble. They have been called several times and they just keep getting more serious,. Like this one is that Icalled and said that I called treatening to take his unborn child after birth , While I am not even liveing in state and have to access to his phone number to call. My questions is that he calls on me every 2-3 months, can I counter claim on him?

Making false claims is a crime in New York an he can be prosecuted, the problem is proving it. I suggest that you tape record all his calls and try to bring up his false claims. You might get an admission out of him. Taping telephone calls is legal in New York as long as one of the partys knows it is being recorded.
