Legal Question in Criminal Law in New York
I heard that I was named in a police report so I called the local police to see if, in fact, I was. The records division told me I was named as a suspect in the police report and I can not get a copy of it. They told me I need to call the police dept. when the officer is on duty to speak with him. They said he tried to contact me. It has been over a week and I have not been contacted at all. The person is saying I tried to assault them but I have no idea what the police report actually says. I did not try to assault this person. No one was injured and no one went to the hospital or anything like that. No one even saw what happened because we were in a seperate room. The person did not press charges against me. I am confused as to why I cannot see a police report I was named in. What does it actually mean to be a suspect? Is there a chance I could be arrested? Is this something that could blow over and go away or do I need to hire a lawyer to deal with it? Thanks.

Do not take any action on your own without retaining a competent criminal defense attorney. Any statements you may make will be used against you. Furthermore the State is the prosecuting agency and even if you think the alleged victim will not press charges , the state can compel his/her testimony.
