Legal Question in Criminal Law in New York
Homicide motion
My friend has been sitting in rikers island waiting for hearings to start. It has been 24 months and the da keeps delaying the hearings and stalling. My friend asked his lawyer to file a 30/30 motion for a speedy trial but his lawyer said no because their is no statute of limiations on a homicide? What else can be done what other motions can be filed to get things going? What are the time limits the da has to prepare or delay a case?

Never a good idea to rush your lawyer into trial before he is ready. Depending on the level, your friend could be at the death penalty.
